Permission of the Lender

Before letting your property you will need to approach your mortgage lender for permission. With the expansion of the rental sector and increase in the number of investment purchasers it is unusual for this permission to be refused. The tenancy will be drawn up in the full names of all the legal owners and we will ask you to disclose this information when you sign our terms of business.

Tax Implications

Income tax must be paid on the net income from letting a property whether you are a resident or non-resident landlord. The letting income on which you may be taxed is the gross income less certain allowable expenses. Even if you are a non-resident and live and work abroad you will still be liable to pay tax on any amount of income over the allowable expenses.

Safety Regulations and legislation

Your property must comply with legislation such as Gas Safety (Installation and Use) Regulations 1994, Furniture & Furnishings (Fire Safety) Regulations 1988 (as amended) in 1989 and 1993, Electrical Equipment (Safety) Regulations 1994 and Plugs & Sockets etc (Safety) Regulations 1994. All works must be carried out by competent and qualified engineers. Laing Bennett will be able to organise for a Gas Safety Record and Electrical Report for your property before the tenancy begins with the cost being deducted from the first months rent.

Smoke Alarms

We advise that landlords install conforming smoke detectors in all their properties to avoid the accusation that the landlord is failing to properly fulfil their duty of care towards tenants. Failure to do so for whatever reason would be indefensible if and when a case came to court.
